Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the PackVision application (the "Service") operated by PackVision Inc. ("us", "we", or "our").
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
PackVision provides a video documentation platform for e-commerce, consisting of downloadable software ("Station") for local video processing and a cloud-based dashboard for effective management and review. The Service allows users to record, store, retrieve, and export video clips linked to specific tracking numbers or order IDs.
3. User Accounts
- You must provide accurate and complete information when creating an account.
- You are responsible for safeguarding the password that you use to access the Service.
- You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
4. Content and Data Retention
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.
Data Retention: Video content is retained for a duration determined by your active Subscription Plan ("Storage Limit"). We provide an additional 3-day grace period beyond this Storage Limit before permanent deletion occurs. During this grace period, data may still be recoverable for emergency purposes but is not guaranteed to be accessible via the standard user interface. After this total period expires, data is permanently deleted and cannot be recovered.
5. Subscription and Billing
Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually).
- Free Trial: We may offer a Subscription with a free trial for a limited period.
- Cancellation: You may cancel your Subscription renewal either through your account management page or by contacting our customer support team.
- Refunds: Certain refund requests for Subscriptions may be considered by PackVision on a case-by-case basis.
6. Limitation of Liability
In no event shall PackVision, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service.
7. Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
9. Open Source Software
The PackVision Station software may utilize independent third-party open source software libraries ("Open Source Components"). These components remain under their respective licenses.
- FFmpeg Libraries: The Station may utilize FFmpeg libraries. FFmpeg is a trademark of Fabrice Bellard, originator of the FFmpeg project. This software uses code of FFmpeg licensed under the LGPLv2.1 and its source can be downloaded here.
- Any Open Source Components are subject to their respective license terms. Nothing in these Terms limits your rights under, or grants you rights that supersede, the terms and conditions of any applicable Open Source Software license.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.
